It could be both, I guess. Whatever the reason, estate planning is an important topic, regardless of your station in life. |

So what does it mean to have an estate plan? The better question is: why does it matter? This is not easy stuff. It deals with death and dying and the future. Of course, nobody wants to think about this stuff. But unfortunately, it's the pink elephant in the room. And it's not all that bad, actually. Generally, an estate plan is a set of instructions that spell out how your property should be managed and distributed during your life and after death. The attorney (yours truly) is basically a conduit that channels your wishes onto paper in a way that make sense and have the most effect. Okay, maybe it's not that simple, but this should give you some idea. The estate plan should be a reflection of your life and vision. And don't confuse the word "estate" with a gated 8000 square foot villa with your initials on the entry gate. Your estate is all that you own in real estate and other assets. At one point or another, most of us who own property think about what will happen to our property when we die. We think about stuff like, "Who will get my 1984 Honda Civic?" That's a legitimate concern. Nobody is going to want it, but the concern is no less legitimate. But what if you become disabled? And what happens when you get old and feeble minded? There may come a time where we will live out our lives without sufficient mental and/or physical capacity to manage our own affairs. Look, we all know or knew someone who started to "lose it." We can all remember thinking this or saying something like, "hey, is it me, or is Uncle Shlomo beginning to lose it?" Enter the estate plan. The estate plan deals with the management of your property and financial affairs. There are two main types of estate plans: one is built around a Will and the other around a Revocable Living Trust. Each has it pros and cons. But as long as you have your wits about you, you can always make changes to the plan along the way. That being said, it's important to have an estate plan in place now because you don't know when you might become the "Uncle Shlomo." THE WILL A Will is the most common document used to specify how an estate should be handled after death. The person or entity designated to receive your property under the Will is called a Beneficiary. The person whose property is to be disposed by the Will is the Testator or Testatrix. Like a Trust, the Will can set out different instructions, such as who gets certain property or who will be the guardian of Testator's minor child in the event that no parent is alive. It can be used to disinherit someone. It can set conditions on inheritance, such as the requirement that the Beneficiary first reach the age or 25 or graduate from college. And then there's the dreaded P word - PROBATE. There's no getting around it. When a person dies and leaves property in a Will, probate is the legal proceeding that is used to wind up his or her legal and financial affairs. It's best described as a court-supervised process by where assets are gathered, valued, and distributed according to the Testator's last wishes as stated in the Will. Probate proceedings are held in Superior Court for the county in which the Testator lived. The Executor (the person who administers the estate) is responsible for protecting a deceased person's property until all debts and taxes have been paid, and seeing that what's left is transferred to those who are entitled to it. Their job includes making an inventory of the estate's assets, locating creditors, paying bills, filing tax returns, and managing the estate assets. Finally, when this is all done, a petition is filed with the court requesting a distribution to the Beneficiaries. The whole process can take many months and sometimes years to complete. As you can imagine, probate can also be very expensive. The Probate Code sets the maximum amount that attorneys and personal representatives (i.e. executors, administrators, etc.) can charge. As of 2011, the fees are four percent of the first 0,000 of the estate, three percent of the next 0,000, two percent of the next 0,000, one percent of the next ,000,000, and one-half percent of the next ,000,000. On top of that, a probate referee is appointed to appraise all of the non-cash items. This person usually takes one percent of the total assets appraised. All of this can add up very quickly. Although it's safe to say that most of us will probably not die with an estate valued at million, the probate process can easily reduce the size of the estate by tens of thousands of dollars. And of course there's the privacy issue, or lack thereof. When a Will is admitted to probate it becomes a matter of public record, including the details of what your assets are and who's in line to get them. Some may have legitimate reasons for following the probate matter, like a beneficiary's creditor who's looking to collect. Other unscrupulous types may want to know who to bamboozle. THE REVOCABLE LIVING TRUST A Living Trust is established with a document, usually a Declaration of Trust or a Trust Agreement. It's basically a relationship whereby property (real or personal, tangible or intangible) is held by one party for the benefit of another. A Living Trust conventionally arises when property is transferred to a separate Trustee to hold for the Beneficiary. However, that's not always necessary. The person creating the Living Trust is called the Settlor or Trustor (these are synonymous). The Settlor appoints a Trustee to manage the Trust assets. The Trusee holds legal title to property for the benefit of another, also known as the Beneficiary. Although the Beneficiary does not own legal title to the property, he or she is said to own beneficial title. So you can imagine that the Trustee cannot do anything with the property that does not benefit the Beneficiary, like sell some off and pocket the money. It may be easier to think about a Trust like a Corporation. The Trustee is the CEO and the Beneficiaries are the shareholders. And it's not uncommon for Trustee to also be a Beneficiary, although it's advisable that a Co-Trustee be named as well. A Living Trust should usually be accompanied by a Last Will and Testament, also known as a "pour-over will." The Will should say that property that is outside of the Trust is to be distributed to the Trustee of the Trust when the Testator dies. As long as the property outside of the Trust is valued at less than 0,000, probate can be avoided. The benefit is that property not previously placed in the Trust will get "poured" into it. Even if the property exceeds 0,000 and has to go through probate, it will eventually be distributed according to the instructions of the deceased instead of being distributed according to California law. It may also be a good idea to name the same person to be both the Executor of the Will and the Trustee of the Trust, since he or she will dealing with the same property. WHAT DOES THIS ALL MEAN? So what's the point of all of this mumbo jumbo? Well, just that it's easy to overlook the necessity of a proper estate plan. A Living Trust helps to protect you, your assets, and those people and/or entities who you want to leave your assets to when you're gone. A good reason to create a Living Trust is to keep your estate plan private. Unlike a Will and probate, the Living Trust is a private contract between you (the Settlor) and the Trustee. It does not need to be filed with the county. The only way it can become public is if a dispute arises and someone files a lawsuit, which is possible. Another major benefit of a Living Trust is that it has the ability to protect you in the event that you become disabled. The Trust can specify how your incapacity should be determined, how you should be taken care of if you're deemed disabled, and who will be able to manage your property if you can't. A Living Trust is written so that your Trustee can automatically jump into the driver's seat if you become ill or incapacitated. This will keep you and your property outside of court-supervised guardianship or conservatorship. The more you can keep the court out of your life and affairs, the better. A Living Trust also allows you to dispense with your property in the manner that you choose. For example, many families have a child who has or had some problems in life. This may range from physical challenges to addiction to partying in Las Vegas with prostitutes every weekend. A Living Trust can provide for financial support to others without giving them direct control of the trust property. Finally, a Living Trust makes it possible to avoid having to go through probate. On a normal journey you may have a long conversation with your friend or relative traveling with you, or you may need only a little small talk to get by with strangers you meet on the journey. But what about a six-hour journey with a group of people you know, but not really all that well? I was always fascinated by the fact that traveling football players seem to play cards for hours on and, as a non-gambler I couldn't see the point of 'wasting' hours trying to win very small sums of money in boring games. But many people are not keen readers or talkers and games of cards or dominoes are a good way for them to pass the time and enjoy each other´s company. In his excellent book about Hollywood, 'Adventures in the Screen Trade', William Goldman explained how the famous studio bosses used to meet every Sunday to play cards for high stakes. These were powerful and rich men who could talk when they wanted to, but tycoons like Louis B. Mayer, Cecil B. De Mille, Jack Warner, Carl Laemmle and so on were fierce rivals in an enclosed and cut-throat industry. The fact was that these guys couldn´t afford normal conversations on a Sunday because they each had too many business secrets about movie stars or contracts, or how they were going to bamboozle each other in the coming week. So they played cards for hours on end. Goldman discloses that the wives of the studio bosses accompanied their husbands on these social visits and were content to let them gamble. What the wives didn't know was that, in order not to alarm them, 'the boys' dropped two zeroes from their wagers so that when they said, 'I raise a hundred dollars,' they meant ten thousand! For anyone who doesn´t want to play cards and can´t talk for six hours it can be a good idea to have an organized discussion and vote on each person´s top ten favorite movies. It's too difficult to do this with books as there will not be enough common ground. Everybody has a favorite movie and most people can explain why they love a particular film while someone else in the group is going 'ugh' at the thought of that movie. This is a good way to pass a few hours although it works best if the group is more or less of the same generation. An adult leader of a youth group might have a hard time even recognizing the name of movies the youngsters watch today, while the youngsters just won´t believe that there was a movie called 'The Sound of Music' or 'The Sting' But as well as passing the time the exchange of opinions and memories across the generation gap can be a rewarding and educational experience for everyone. How to Bowl Leg Spin
Leg spin is one of the hardest bowling arts to master. However, when you get a good grip of the art, it can be very effective. There are many variations that can be made to your deliveries, which can confuse the batsmen, resulting in them getting out. These variable deliveries include the leg break, googly, top spinner, flipper and slider. Within these deliveries, you can vary the delivery itself. Whether that is by the speed of the delivery or the amount of revolutions imparted on the ball. |

Leg Break: The leg break delivery is where the ball spins away from the leg side. This is the stock delivery of the leg spinner, hence the name. To bowl a leg break, the ball should be placed in the palm of the hands or in the fingers. The seam should run across the fingers. When bowling the ball, the wrist should roll over so the ball is released from the front of the ball. When rolling the wrists, the fingers should roll across the ball as well, providing extra spin for the ball to turn once it pitches. This delivery can be varied by the line or length of the delivery, the speed of the bowling arm, the amount of spin imparted on the ball or by the amount of flight on the ball (a looping delivery which stays in the air, with a higher trajectory, or a flatter, low trajectory delivery). Generally when bowling leg spin, it is important to flight the ball, in order to tempt the batsmen into a shot and get them out. You and your team mates also have to be prepared that the batsmen may smash you around the park when bowling leg-spin. Googly: The googly (wrong'un) is the exact opposite to the leg break, where the ball spins from the off-side to the on-side. This is an important deviation ball from the leg break as it can completely bamboozle the batsmen if they are not watching the ball carefully, with intense concentration. To bowl a googly, instead of releasing the ball from the front of the hand, the ball is released from the back of the hand. The spin applied to the ball is clockwise, instead of the standard leg break delivery which has anti-clockwise spin. Flipper: The flipper delivery is where the ball has a lower flight path, and stays low. The ball has backspin imparted on it, while being released underneath the hand. The ball should be place in between the fingers of the thumb, the index and middle. When releasing the ball, these fingers should click together, which causes the ball to squeeze out underneath the hand. This will cause a lower flight path, with the ball having a flatter flight path, resulting in a fuller pitched delivery and a low bouncing delivery. Top spin: The top spin delivery is where the ball dips sharply, and then kicks up at the batsmen. To bowl a top spinner, the ball should be held like a leg break, with the seam across the fingers, with the thumb, index and middle finger gripping the ball. The wrists should face out towards the offside. This wrist position means that the fingers and wrist impart over-spin or top spin on the ball, instead of leg spin. The ball then loops up, then dips down shorter than what a normal delivery would, with a higher bounce. The ball goes straight on towards the batsmen, instead of turning. Slider: The slider delivery is where the ball floats in the air, and then stays low. This delivery is opposite to the top spinner, which bounces at a shorter length, and then bounces up high. The slider delivery is bowled with the thumb facing the bowler (opposite to the top spin which has the thumb facing the batsmen). Upon release of the ball, the ring finger and the wrist work in tandem to impart back spin on the ball, with the ball releasing from in front of the hand. |

Outside of some sort of GPS proof, look up your local jurisdiction's rules to find out what requirements the officer has to have on the radar gun or training hours for the gun. If either of these are out of date, then the radar's evidence can't be admitted to the court as evidence which means the case will be thrown out. |

Magic refers to control of external circumstances through mental means and anyone who practices magic is called a witch. 'Spell' is the witch's word for prayer because like a prayer a spell is an appeal to the higher powers for the fulfillment of a desire. Thus, a spell is a way of worship and need to be enacted with the dignity a sacred rite deserves. The way a spell is cast depends up on the complexity of desire and it can be as simple as chanting an incantation or as elaborate as fertility dance. However, there are some basic methodologies that apply to all spells. The first step to magic spell is to consult the phase of the moon to determine the appropriate time for performing the spell. On the chosen day the witch casts a circle and calls of the four quarters. This basically means that the witch consecrates the space with circular (or spherical) boundaries and evokes the spirits and Gods within that space to bless their magic. The manner in which this is done depends entirely on the witch. The next step refers to the offerings given to please the Gods and direct them towards the heart's desires. These include candles, herbs, crystals and essential oils among other things. For instance, in a spell to attract wealth, there are green or gold candles, herbs like patchouli and dill and the crystal that works best is malachite. It is not necessary to have all these things present since obtaining them can be an expensive affair. If the intent is sincere enough, even the most minimalistic ritual will work. The same ritual may need to be repeated over a number of days to achieve results. Before the spell is concluded, the quarters need to be thanked then sent away and the circle has to be closed. It is essential to remember that magic works on the principle of what goes round, comes round and so individuals need to be careful what they wish for. |

BUILD YOUR CARNIVAL AROUND A REALLY GOOD THEME By selecting a different theme for your carnival each year, it both keeps your families interested and engaged, and also it forces your planning committee to develop new ideas for games, events, costumes, food choices, etc. The selection of a theme is the foundation for the rest of your carnival planning. It is vital to keep your auction from becoming predictable each year. KNOW YOUR AUDIENCE It is important to know what kind of people will be attending your carnival. This demographic knowledge will help you in deciding what kind of a theme to choose and what kind of activities will make you the most money. Basically, make sure you are giving your audience what they want. If karaoke is popular, give them a karaoke booth. If a football throwing competition would be popular, give them that. If you think silly string would be a big seller, have plenty of that on hand and mark it up. THINK LIKE A GUERILLA (MARKETER) The key to making a lot of money at your carnival is to have lots of people there. Make sure you have an excellent team in charge of getting the word out. First, utilize every method of free publicity: press release, road-side banners, lots of fliers in shops over town, church bulletins, etc. Also let your school families know how important attendance is and that their efforts in bringing others to the event is encouraged and appreciated. After you have exhausted these low or no cost means of advertising, perhaps you can consider a well-placed paid advertisement in the local paper or radio station. Only do this if you've had success in the past and can afford it. There are so many means of cheap marketing. SECURITY AT DOORS = PARENTS FEEL SAFE Once parents have arrived, they want to make sure their kids are safe to run around. This sense of security will go a long way toward making mom and dad comfortable and willing to spend more money. I know that if I'm constantly worried about where my kids are and what they are breaking, I'll be looking at the clock and planning my exit strategy. I'm not going to drop a lot of dough. Make sure to have volunteers specifically assigned to the front doors to make sure no one escapes. I would also station a male and female adult by the bathrooms to make sure no trouble happens there. Try to imagine any place there could be trouble in your physical space and solve the problem before it happens. SEEK A WIDE VARIETY OF DONATIONS One way to make money is to not spend it in the first place. Therefore, do everything in your power to get food and supplies donated. This process should happen very early in your planning. Seek out natural connections within your school community. Who knows, one of your sudent's dad might own a company that rents out inflatable bounce houses and would be willing to rent them to you for free. You won't know until you check. Make sure to give out a lot of recognition (both verbally and through prominent signage) to all those who helped, and make sure that a committee takes responsibility for sending out thank you letters to every single person or business that helped you during the carnival. CHARGE FOR VENDOR BOOTHS In addition to the rides, games, and scheduled entertainment at the carnival, there is an opportunity to provide parents and kids with another great experience: vendor booths. You can sell booth space ( can be as simple as 8' folding tables) to local business who want to market to your specific audience. You can also require the vendors provide some kind of freebie or activity to whoever visits their booth. Pencils, Frisbees, coloring books, etc- and they can put their logo on everything they give away. They can pass out coupons as well. This is a great marketing opportunity for the business and it adds to the overall excitement of the event. If you get enough vendors, you can also make some decent money off of it. If you charge 0 per booth and get 12 booths, you just made ,200 pure profit. And, 0 for such a great marketing opportunity is not out of reach for many local businesses. I have even heard of carnivals with booths set up for health and wellness information, including free flu shots, blood pressure screenings, for example. You can give price breaks on booths to non-profit groups, if you wish. The more booths = more excitement. SELL TICKETS FOR EVERYTHING- KEEPS CASH AT A MINIMUM Take a cue from most arcades out there today, convert cash into tokens or tickets whenever possible. This accomplishes two important purposes. 1) It prevents individual booths from having to handle and secure cash. With all the excitement and activity, why take a risk on cash being lost, stolen, or mishandled in any way? 2) People are much more likely to spend tokens or tickets freely than real cash money. It's a psychological thing. TAKE PLASTIC Even though you may lose a few percentage points for the transaction, I recommend setting your carnival up to accept debit and credit cards for tickets and maybe some of the higher price add-ons you have. This way you avoid the situation of a parent running out of cash, even though they still want to make that last minute purchase. Don't lose that sale! PLAN SOMETHNG FOR EVERYBODY In your planning, make sure that you include activities for everyone. For instance, you may get lots of younger siblings. It would be wise in this instance to set aside a safe area for them to crawl and play without having big kids risk accidentally hurting them. A few gym mats, some baby toys, a fence of some kind, and chairs for parents could be all that you need. Even if you offer this toddlers' area for free, you are doing a service for parents who won't have to spend money on babysitters or feel rushed to leave, due to their younger children. On the other hand, it would also be wise to provide lots of seating areas and coffee (decaf) for grandmas and grandpas. Make sure that nobody feels uncomfortable or un-catered to. The more people through your door, the more ticket revenue you pick up. BOOK A GREAT EMCEE I am a strong believer in designating someone to serve as the overall host or emcee for the event. Give this guy or gal a wireless mic and let him or her use charm, humor, prodding, and enthusiasm to get people having a great time and spending money. Don't settle for a bland voice telling people the talent show starts in five minutes. Get a person who will have the natural ability to hype it up. The emcee can also call attention to booths that aren't doing well and need attention. Just make sure that the emcee doesn't cross the line into being obnoxious. This can be a tall order, but if you get the right person, it can make a world of different to your event. FOOD, FOOD, FOOD Basically, forget everything else I've written. It's really just all about the food. People love to eat and they'll spend money to do it. Offer as many choices and styles as you can think of. If people like to eat it and it's convenient to mass produce and serve, do it! I really don't think you can over-do it on the food. This is an opportunity to really hype up a specific item. For instance, this could be the only time all year that third grade teacher Mrs. Riley makes her world-famous elephant ears. Your school carnival is the only place on Earth to get them. "Tell your friends and family! Don't miss this once a year chance!" (Remember to get as much of the food donated as you can, because it would then be 100% profit!) OFFER LOTS OF PLACES TO SPEND MONEY Besides selling tickets for games and food, think about ways you can sell additional items. I know of carnivals who have successfully sold student designed t-shirts, school community recipe/cookbooks, family photos, and raffle tickets, to name a few. Also, look at the Oriental Trading Company Catalog for very inexpensive items that kids love to have. Silly string for instance is a great seller. You can even set up a little store for any of the above mentioned items. Don't miss any opportunity to get people to spend their hard-earned dollars for your school. LEVERAGE THE "CELEBRITY" OF TEACHERS, PRINCIPAL Kids are always amazed to see their teachers in any situation out of the classroom. I remember thinking that my elementary school teachers actually lived at school. They couldn't possibly have a life in the "real world". To run into one of them at the grocery store was like running into a movie star or the President of the United States. You will be sure to have a hit activity anytime you can put a teacher in a funny situation. Think dunk tank or pie throwing, etc. Maybe the principal could get his head shaved if a certain level of money is raised that night.
